This Custom Jewellery Non-Cancellation & Legal Liability Policy (“Policy”) governs all custom, bespoke, personalised, and made-to-order jewellery orders placed with Shrinika Diamonds (“Company”, “we”, “our”, “us”).

By placing a custom order, the Customer (“you”, “your”) enters into a legally binding manufacturing contract enforceable under the Indian Contract Act, 1872, Sale of Goods Act, 1930, and other applicable laws.
The terms below are final, non-negotiable, and irrevocable.

1. LEGAL STATUS OF CUSTOM ORDERS

1.1 All custom jewellery orders constitute a special manufacturing contract, protected under:

  • Section 10, Indian Contract Act – Legally enforceable agreements

  • Section 16, Sale of Goods Act – No implied warranty/cancellation for custom goods

  • Sections 73 & 74, Contract Act – Compensation for breach

1.2 Once the order is confirmed, you are legally bound to the contract without exception.

2. ABSOLUTE NO-CANCELLATION POLICY

2.1 ALL custom orders are strictly non-cancellable, regardless of circumstances, including:

  • Change of mind

  • Unexpected event

  • Delay in delivery

  • Personal reasons

  • Gift dissatisfaction

  • Financial issues

  • Dislike of final appearance

  • Miscommunication

  • Third-party opinions

2.2 Cancellation requests will be automatically rejected under Section 56 & Section 73 of the Contract Act.

2.3 Attempting to force cancellation through threats, abusive behaviour, chargebacks, or manipulation may result in:

  • Immediate contract enforcement

  • Legal notice

  • Filing under IPC 420 (Cheating)

  • Blacklisting of customer

3. NO-REFUND & NO-RETURN POLICY (STRICT ENFORCEMENT)

3.1 All payments made toward custom orders (including advance, balance, partial, milestone, or full payment) are 100% NON-REFUNDABLE, regardless of:

  • Design dissatisfaction

  • Weight variations

  • Colour/size differences

  • Customer measurement errors

  • Delivery delays

  • Personal issues

  • CAD misunderstandings

3.2 Custom goods cannot legally be returned or exchanged, as per Section 16 of the Sale of Goods Act.

3.3 Any attempt to demand a refund will be treated as breach of contract.

4. NON-REFUNDABLE ADVANCE PAYMENT (STRICT)

4.1 The advance amount is fully non-refundable.
It covers:

  • Gold locking

  • CAD creation

  • Stone sourcing

  • Labour allocation

  • Hallmark/certification booking

  • Production slot blocking

4.2 Refund WILL NOT be issued even if:

  • Production has not started

  • Customer withdraws order

  • Customer delays approvals

  • Customer fails to provide necessary inputs

5. CAD APPROVAL & CUSTOMER LIABILITY

5.1 Once the customer approves the CAD design (via WhatsApp, email, message, or written confirmation), it becomes legally binding.

5.2 The customer assumes full responsibility for:

  • Size

  • Dimensions

  • Stone layout

  • Proportions

  • Thickness

  • Design elements

5.3 After approval:

  • No modifications

  • No alterations

  • No cancellations

5.4 Any dissatisfaction arising from approved design is solely the customer’s liability.

6. WEIGHT VARIATION – LEGALLY ACCEPTED TOLERANCE

Custom manufacturing may result in weight differences due to real-world production limitations.

Accepted variations:

  • Gold weight: ±10%

  • Diamond weight: ±5%

As per industry norms, this is NOT a defect.

The customer agrees to:

  • Pay additional amount if weight increases

  • Accept no refund if weight decreases

The final invoice is legally binding.

7. PRODUCTION TIME & DELAY LIABILITY EXCLUSION

7.1 All timelines are estimates, not guarantees.
7.2 Delays due to:

  • Stone availability

  • Artisan load

  • Hallmarking/certification queues

  • Festivals/peak season

  • Logistics issues

  • Force majeure

DO NOT qualify for cancellations or refunds.

Under Section 56 of the Contract Act, uncontrollable delays do not void the contract.

8. CUSTOMER-PROVIDED DESIGNS & INSPIRATION IMAGES

Shrinika Diamonds will interpret the design to the closest feasible extent; however:

  • Exact replication of external designs is NOT guaranteed

  • Differences in finishing, structure, setting, or crafting ARE permitted

  • Customer dissatisfaction based on comparison to reference images is not grounds for dispute

9. FINAL PRODUCT APPEARANCE DISCLAIMER

Minor variations in:

  • Colour

  • Tone

  • Clarity

  • Stone pattern

  • Shine

  • Proportions

  • Texture

are NORMAL and do not constitute defects.

Shrinika Diamonds is not liable for design perception issues or expectation mismatch.

10. CERTIFICATES, HALLMARKING & DOCUMENTS

10.1 Custom jewellery will be issued with:

  • BIS Hallmark

  • IGI/GIA/SGL certification (for diamonds, if applicable)

10.2 Loss of certificate invalidates all claims, including:

  • Exchange

  • Repair

  • Warranty

  • Authenticity disputes

Replacement cost must be paid by customer.

11. INTELLECTUAL PROPERTY RIGHTS

All CAD files, technical drawings, sketches, 3D models, and digital assets are:

  • Intellectual Property (IP) of Shrinika Diamonds

  • Protected under the Copyright Act, 1957

Customers cannot:

  • Copy

  • Reproduce

  • Modify

  • Share

  • Outsource or replicate

  • Give to another jeweller

Legal action may be initiated for infringement.

12. FRAUD PROTECTION & VERIFICATION

Shrinika Diamonds may require:

  • KYC

  • OTP verification

  • Address proof

  • Video confirmation

  • Additional identity checks

Suspicious orders will be:

  • Immediately cancelled

  • Reported under IPC 420/468/471

  • Permanently blacklisted

13. FINAL DECISION & DISPUTE RESOLUTION

Shrinika Diamonds’ decision regarding:

  • Weight

  • Design

  • Quality

  • Pricing

  • Timeline

  • Adjustments

  • Variations

  • Warranty

  • Acceptance

is final, binding, and non-challengeable.

All disputes fall under the exclusive jurisdiction of courts in [your city], excluding all other courts.
